A Pre-Nuptial Agreement is a written document signed before the marriage setting forth the parties’ assets and liabilities and establishing alimony and property division, if any, if the parties end up getting a divorce. In order for a court to enforce a Pre-Nuptial Agreement in Massachusetts, it must be deemed to be fair when signed and fair when enforced. It is getting difficult to challenge a well-written prenup. However a prenup cannot impact the court’s awarding of custody or child support.
