Maureen McBrien filed an appeal on behalf of the Mother claiming the trial judge abused his discretion in awarding equal parenting time to both parents, awarding joint legal custody over educational decisions to Father and ordering the children be moved to another school district where they had never before attended school, without independently evaluating the evidence. The Judge adopted, almost verbatim, Father’s proposed Findings which did not address Mother’s evidence, much of which was uncontested by Father. The Appeals Court vacated and remanded the matter for further proceedings the portions of the Divorce Judgment as it relates to the parenting schedule, joint legal custody over educational matters and placement of the children in another school district.
